It is an offence in Victoria to sexually penetrate a person under the age of 16 (Crimes Act 1958, s45(1)). However it is a defence if the younger party was aged 10 years or older and the offender was not more than 2 years older than the younger party (s45(4)(b)). Further it is an offence for a person to sexually penetrate a person under the age of 18 if that person is under the care of the offender (s48) (guardian, teacher etc). A person under the age of 18 is not allowed to work as a prostitute nor to be in a brothel."

St Kilda Media Statement
6:33 PM Wed 26 May, 2010

St Kilda Football Club can confirm it has been working closely with the AFL on a matter that involves two young players and a teenage female, which has been reported widely in the media today.

The conclusions of the investigation are:
The relationship between each of the two young players and the teenage female was consensual and started after the two young players were introduced to her, following the match in Sydney on 27th March.
The players did not obtain the teenage female’s contact details when attending an AFL school visit.Phone records reviewed thus far by the AFL confirm that there was no contact made to the teenage female prior to the match in Sydney on 27th March.Victoria Police has confirmed to the AFL that they have interviewed the teenage female and will be taking no action.
The AFL has interviewed the teenage female and confirmed that her story independently supports the statements made by the players. No names will be released as this is a private matter and the Club will be taking no further action.

AFL probe clears St Kilda players over sex claim
From: AAP May 26, 2010 6:42PM Increase Text Size Decrease Text Size Print Email Share Add to Digg Add to del.icio.us Add to Facebook Add to Kwoff Add to Myspace Add to Newsvine What are these? THE AFL have cleared two St Kilda players of inappropriate behaviour during a school visit, following allegations by a teenage girl.

The Victorian schoolgirl claims she is pregnant after having sex with the two players.

The 16-year-old girl reportedly met the players, who are yet to be named, at a high school football coaching clinic and later reintroduced herself to them in Sydney following the club's round one match against the Swans on March 27.

But the AFL released a statement late on Wednesday, saying there was no evidence she had met the players during the school visit.

"The AFL's concern in relation to this matter was whether any AFL player had acted inappropriately during the course of a school visit," the league said in a statement.

Mr Anderson (AFL operations manager Adrian Anderson) said that all available evidence indicates that the players had no contact with the young woman at an AFL player appearance at the student's school, but met for the first time some weeks later after an AFL match following round one of the 2010 season.

"The St Kilda players have agreed to provide their telephone records to the AFL. The records provided so far corroborate this fact.

"Mr Anderson said this is a private issue between the parties and the AFL will take no further action."

It is not known when the Saints will finish their investigation into the claims.

"It had been alleged that the two players had made an official appearance at the girl's school, however general manager of football operations Adrian Anderson said the girl met the players for the first time after a round-one AFL match some weeks later.

"The AFL has spoken to the girl, her family, Victoria Police, the Department of Education, the two St Kilda players and other witnesses.

"Mr Anderson said Victoria Police had interviewed the student, provided a report and determined they would take no action, as no unlawful activity had occurred," a statement read.

"Mr Anderson said that all available evidence indicates that the players had no contact with the young woman at an AFL player appearance at the student's school, but met for the first time some weeks later after an AFL match following round one of the 2010 season.

So then...

Who was the...ahem... journalist who broke this story?

Why did they break the story?

What purpose did breaking the story serve?

Did the journalist ask a single question of anybody before publishing what can only be described as a less than half-baked rumour?

What was done by the journalist to corroborate the most important fact in this story (ie the 'school' bit)?

What sanctions apply to ... ahem ... journalists in these circumstances?

In circumstances where players names are being splashed about pretty much EVERYWHERE online, is there any course for recompense?

What does the girl think about all this? Was she asked? Was her family asked?

Why is it a private matter after the story broke and not before? Did the journalist enquire as to the matter's status before tapping out his words?

What will the child, once old enough, think about all this?

Has the journalist concerned at any point actually engaged his brain to any meaningful extent at all?

Is this really what we have become?

How f*cking sad.

This may sound hypocritical, but I find it is a shame that the boys had to be dragged throughthe mud and their names becoming common knowledge amoung the afl fans and industry. It is understandable though that particuarly St.kilda fans want to know who was to blame and seeked to find out, party because we embody part of all the players with the amount of passion we place in the team each year. However I think the way the media behaved in this instance was deplorable, it was pretty evident from early this morning that it was purely a private matter, even if it was not a private they could of held the story to confirm the facts before distributing stories that led many to believe police action would be necccessary and essentially slandering the players, club and AFL . Instead as in so many cases before the media acts before the story is known or manipulates the facts to essentially destroy someones reputation and sometimes life.

Such a serious issue, there is no easily available legislation for the average person and the fact that this type of stuff isnt taught in schools at all, or well enough.

All the very best to those personally involved from every angle on this topic.
Exactly, I think I have always just assumed it was 18, so many of us will have learned something from all this. Like not to assume anything.
And it's no surprise that so many aren't aware of what the law states. There are so frickin many of them now (Nanny state, anyone?) that it would just about take us a lifetime to learn them all.

It is also the young woman involved who has been dragged thorough this. I am sure she is having a hard enough time dealing with being pregnant at such a young age. I hope for everyone concerned the story is now put to bed and they can get on with their lives.

To be brutally honest, i dont even care, this is the biggest non-event in the history of afl.
The players have been cleared so really who gives a f***? Because i dont!
I now find it funny that it caused such a stir.
I must say that i hate the media more than i hate collingwood....its ridiculous!!!

Agreed.

Sporting journalism, especially surrounding AFL is absolutely bottom feeding, desperate stuff.

I'm agitated for the players. To have their names dragged through the mud. IT makes no difference that no publication has "named" them as such, everyone knows who they are..

I'm also agitated for the girl and her parents. Seriously WTF.
How would you feel?

Why does the world need to know about this anyway? If there are no legal questions about the situation, then surely it SHOULD be a matter between the direct parties involved.

It is sad that the football world now seems to feed off this.

Most of us would have spent the day around the water cooler defending the damn club. I am sick and tired of it always being our club put through this shyt.

My final word I promise :-) remember this situation can be avoided if any person having sex and not wanting a pregnancy uses a condom ( and other contraception). This can be used as a lesson for all young people... think how you would have felt in this situation. The choice is use a condom it costs $2 don't use one and you may have to pay many thousands of dollars over your life for a child.

Messy, with lots of porky pies

As far as I can recall;

It is an offence to have consentual sex with a girl under the age of 16; and

It is an offence to have consentual sex with a virgin under the age of 18 if the male is over 21

It appears highly unlikely that any offence has been committed it this case

It appears highly likely that a couple of players are guilty of gross stipidity (dingers can be bought from any 7Eleven) !!

Surely that is correct.... Never heard that before - and proving it would be a whole different story.

That could get anyone into trouble - becasue Ive never heard anything remotely related to that in my entire life.

And when they details 'met' at a school clinic - They said she was one of 30 students who greeted the players as they arrived.

Numbers apparently were exchanged in Sydney.
