If the AFL decides the WCE FC breached the AFL code of conduct too many times, and penalise the club by taking away draft picks and imposing massive financial sanctions, then if by all rights they lose their first and second rnd draft picks (including the ones involved in the Chris Judd trade to Carlton) then the draft picks Carlton gave up as part of the trade for Judd (picks 3 and 20) should automatically be returned to the Blues IMHO.

No I am not joking, we gave up picks 3 and 20 (along with Josh Kennedy) to one set club, the Eagles, in order to get Judd, and I think if the Eagles strip them of those picks, I think the AFL has no choice but to return them to Carlton ...
We gave up those picks in order to compensate the Eagles, and if they aren't allowed to have those picks, then surely Carlton has every right to claim them pack, I don't want our no 3 pick going to Melbourne.

I think the Carlton FC would have a very reasonable and strong case to mount that we should get those draft picks if WCE lose them (which btw I hope they don't as that club and fans have suffered far too much in the last 18 months) but under current technical/AFL rules, the blues would be able to get back their draft picks along with Pick 1 and Juddy, if the Eagles lose their picks, and although it may not seem fair that in this case, Carlton would have only lost Josh Kennedy for the greatest player the game has seen since Ablett/Carey retired, but in fairness and logistical sense, the AFL has to return those picks to Carlton if they decide to strip west coast of them after the Ben Cousins fiasco.

Nah, been busy with other responses, but technically I've yet to hear any legal or logistical reason why my view is wrong apart from anti-Carlton hyperbole ?

There is a train of thought that if the West Coast lose their picks, esp ones involved in the trade, then they should be handed back to Carlton, otherwise we would have lost picks 3 and 20 for nothing really (apart from the fact we got Juddy )

If this scenerio got played out in a cout of arbitration, I am convinced Carlton would stand a very good chance of winning and getting those draft picks back if West Coast lost them.

No harm in asking/trying anyway ?

To be consistent* they should also lose pick 18 from 2000 and return Daniel Kerr back to us.

what I meant was,
you know how the afl threatened to take away draft picks from west coast.

say for example.
if the eagles had the no.1 pick.
and that was taken away from them?
and say if the saints had pick 2.
would technically the no.2 pick be the no.1 pick. because the saints would pick first even though they really had the no.2 pick?

I think the way it would work is that West Coast would retain the picks, but would be unable to select a player with them ... similar to a "pass".

So in that sense West Coast don't really lose the "picks" themselves (in the sense that they go to some other club) ... they simply don't take a player with the pick and everyone shuffles up one.

For example, St Kilda would retain pick #9, but it would be the "eighth" player taken (not counting priority picks).
