Nothing about Bedwell being involved.
GT is continuing to make trouble.
The challenge continues to sound highly credible.
It sounds like Butterss is going to have to be dragged out kicking and screaming.
It also sounds as if Caro has really turned on Butterss now.
Gee we are good at airing our dirty linen in public. Perhaps we could turn St Kilda into a reality TV show...........

There comes a point in every man's life when he has to say, "Enough is enough." For me, that time is now. I have been dealing with claims that I cheated and had an unfair advantage in <redacted>. Over the past three years, I have been subjected to a <redacted>investigation followed by <redacted> witch hunt. The toll this has taken on my family, and my work for <redacted>and on me leads me to where I am today – finished with this nonsense. (Oops just got a spontaneous errection <unredacted>)

Is this really a problem?
In this day and age, are Board challenges and in-fighting really an issue?
The only issue is that it scares players away - I highly doubt that would happen.
Or scare members away - why would anyone not buy a membership based on 'off-field trouble'?
Or scare off sponsors - that's possibly the only concern.
It will settle down - once all parties are gone.

I do find it amazing that we've allowed this situation to develop regardless of the merits of the claim. I hope other disgruntled employees have been dealt with in a more professional manner.
The whole situation should have been resolved 12 months ago and the deal to have a payment based on not criticising the club or individuals at the club has to be one of the most bizarre termination agreements a club has had with a disgruntled ex-coach.

The two-part writ, which St Kilda must respond to within 28 days, included a $100,000 demand Thomas claimed was promised to him upon his sacking on the condition that he did not criticise the club or individuals at the club

What I was trying to post was the following:-
That I have had some experience in both lawsuits and counter claims and the 10 page 'statement of claim' by GT is probably filled with 'legalized ambit claim'.
My guess is that the 'holiday pay' claim is just that and the nub of the claim is probably the 100k GT feels he is owed and the Club obvioulsy feels he is not entitled to.
As to JD's question on whether the 'clause' also prohibited GT being publicly slammed - I would doubt it very much. IF it was in the agreement then GT would be able to sue for breach of the agreement and since he apparently hasn't mentioned this in his 'statement of claim' it most likely wasn't in the original agreement.
BTW, there are many instances in industry wherre there are 'non-disclosure' and 'non-compete' clauses in termination agreements, but I don't recall too many (if any) which have a 'subsequent payment' attached to it.

I know enough about Legals to state the following...
1/ 90% + of these type of claims are directed to mediation prior to finding there way to Court
2/ Over 90% of these type of claims are settled at mediation
3/ Ambit claims are always part of any writ from the issuing party with the express purpose of negotiation the reason for inclusion
4/ No matter the wording or expression of the document there will be so much grey area in the relation to the public comments that GT has made regarding StKFC that the nominal amount involved ($100K) would be eaten in legal cost if fought in court
The outcome IMO - GT wants his holiday pay and entitlements and will drop the ambit claim on receipt of the aforementioned in mediation.
I’d take a punt on this outcome if anyone is interested
