When I googled this I found a report in the Herald Sun from may 2012 that stated that it was extremely unlikely that the case against Milne would proceed. I cant post the link it wont work. So what has happened in the past 12 months. Why now?

The official pretense seems to be that the initial investigation was reviewed and found to be "substantially inadequate"

interesting that the original outcome of the review was that all evidence was to be documented and filed better. Once this has happened the sexual crimes division has said the evidence was "substantially inadequate". Somehow this has extended to now having enough evidence to charge him. So either new evidence has been found, old evidence has been dreadged up or those in power have different views on the strength of evidence.

I feel sad for both sides. I can only go on what I have read. Maybe he is guilty and the victim will finally get their justice but it did not seem clear cut. But it needs to be plain, rape is wrong on every level. But not every accusation is correct nor are all those accused guilty.

How do you know she wanted that. Anyway the way I see it is that if Milney did it then i hope he cops the right whack. I have heard various reports over the years and one of them was from a cop very close to the case and rest is second hand from friends of Milneys. The problem is all the reports are one sided and all say Milney is innocent so it is hard to give an honest opinion. All i can say is it is hard to prove rape but not guilty will never mean Milney is innocent in the eyes of many. I really do hope he is innocent though but not for our club but for his family.

I do not think that the civil case will have much bearing on anything - as I understand it - civil cases need to be proved on a balance of probability (ie greater than 50% chance) of the accusation, criminal has to be beyond a reasonable doubt (100% sure). That is why, usually, the criminal comes before the civil.

Spot on, Stinger. The OPI trying to prove it's relevant. As with everything else these clowns have touched, this too, will turn to crap for them. Who's watching the "watchers"? I know they don't lay the charges, and thank goodness for that, but these guys have to try and grab some of the limelight. Sad and scary in equal measure.

Someone's a victim....when the thing has been settled and solved we will then know who the victim is.

Pure and simple there is no happy ending here. For anyone.

Even if he not convicted he still lives with the stigma of being called a rapist by the public at large, not to mention his family living with it. The alleged victim has to go through a trial with the media in her face and fans of a footy club (likely) making he life a tough one to lead. This case will probably cost the football club members and sponsors too. I'm not saying that should be a concern at the moment but its a reality.

In the end I honestly hope justice is done. Regardless of the way it comes out.

JB you should realise people lose all sense of logic when a saints player is involved. If it was a pies player then the girl would be telling the truth. I cant see the need to knock the girl at all unless people know she is lying. My bet is no one on here would even know who she is.
