Not sure how (or why) you keep defending the indefensible, but that's people's right to do so....

It's not quite the same, and it's not a stat dec, but...

In 2006, Jon Obi Mikel claimed he was 'pressured' into signing a contract with Man Utd, when he insisted he really wanted to play for Chelsea.

Chelsea appealed, there was an invesitgation, and it was pretty much proven that he was indeed forced to sign.

They paid Man Utd a certain fee as part of the deal, and Mikel became a Chelsea player.

It's a different set of circumstances (and a different country), but there may well be something a little grey when a party is 'pressured' to sign something, particuarly if there's an agreement (said to be proceeding the signature) which isn't followed through. That may well be what's happened here, I don't know.

The reference to the Stat. Dec. is interesting.

I was witness for a claimant in an action against a major bank, in Sydney, because I knew of the progress of the Application for Advance at the bank, had appended comment and was deemed an "expert witness". I had been head hunted by another bank, so had no alliegance to the defendant bank and had no position to protect. The ultimate approval by the bank was at variance with my appendages to the submission. The bank subsequently withdrew the approval after funds had been advanced and obligations contracted, leaving the client exposed and the bank then selling the project at auction - to a party associated with the bank!

The matter ran for 10 days and the facts presented by the claimant were accepted, as acknowledged by the presiding judge.

I was not subjected to cross examination despite spending a day and a half in "the box".

However, the decision rested absolutely and entirely on the fact that a release had been signed by the claimant at an earlier time.

Costs were awarded against the claimant, who then declared bankrupt.

The claim to the Court that the release had been signed under duress was not accepted because the document had been signed and signed without reservation.

The Courts will normally favour the weaker against the stronger, which is why banks instruct that any security documentation is taken away for execution in the presence of a legal practitioner who acknowledges that they have explained the full import of the documentation prior to the execution.

This "over-kill" by banks is because of the recognition that the Courts will favour the weaker against the stronger, and the bank's security must therefore be water-tight.

The witnessing of the Stat. Dec. (by who, when and where) will be of interest, but, from my experience, I would not like to be in Thomas's shoes regardless.

As stated, if the amount awarded to Thomas is less than the offer, Thomas is liable for the costs of St Kilda FC.

No doubt St Kilda FC have accepted legal advice in this matter over the full course - and have acted in accordance with that legal advice, including by making the (succesive) offers they have.

I would hope that Butters has a mortgage over Thomas's house to secure the monies he lent (plus interest and charges thereon) - or, at least, has lodged a caveat over the property detailing his interest.

A title search at the LTO would be of interest.

It may be Thomas has nothing to lose!

The decision of the Court will, in the normal course, be reserved and handed down at a later date.

It may well be that the matter is mediated at the door of the Court (ie in the ante rooms whilst the County Court is in session) and Consent Orders are handed to the judge for assent.

These Consent Orders may be deemed privilaged, so don't hold your breath until the presentation of St Kilda FC's subsequent Annual Statements - and maybe not even then.

The size of the claim is why it is listed at the County Court.

I still maintain he did a good job for us up to 2004.
Then dropped away after that.

And yes I always felt he was a loyal saints man.
But I concede that his behaviour since Sep 2006 has been disgraceful.
Not sure how much is ego and how much is greed.

And it is particularly poor form to reject the peace offer from the new board.
Since he is hell bent on taking it to court, I hope the court upholds the validity of his stat dec renouncing any monetery claims, and therefore give him nothing except a big fat legal bill.

I won't be defending him any more !


The rest of Australia can wander mask-free, socialise, eat out, no curfews, no zoning, no police rings of steel, no illogical inconsistent rules.
