i reckon freo would be able to form a pretty strong case that lyon made the initial approach to them. given that, i'm not sure how much we'd have against them.BackFromUSA wrote:agreed that the inducing contract breach will probably normally get settled ... probably for $200,000 to $300,000 ...

He is as USELESS as tits on a BullEastern wrote:Our Vice President, Ross Levin is one of the top Employment Law experts in the country. The problem is that he has been over-ruled by the Board before when he suggested we sue KD !!Sainterman wrote:Who does the legal work for the club?
I wonder how tight that contract is in the end.
Wouldn't he have overseen the initial contract, to make sure this sort of thing Couldn't Happen??
Seriously, he is like "war" good for absolutely Nothing!!

Why? Why even bother having contracts at all if you aren't going to enforce your rights in the case of a breach? Let's all live in fairy land and do everything with a handshake, don't want anyone to be cross with us... Screw them, Lyon in particular - the get out clause was not there to be used to jump ship at any time for a better offer - he abused it and should pay the appropraite price, end of story.plugger66 wrote:That was a correct decision and not doing any legal stuff here would also be the correct decision.

They have dumped him as a client, haven't they? Words to the effect of 'since he negotiated his own deal, he does not need our representation'.noreason41 wrote:What about Lyon & The management company?
Does ESP Have any right to sue Lyon over the money they lost as they would have negotiated a contract for him?
Is he under contract with ESP? Or is he allowed to negotiate behind their back?

Initially, it sounds good to "get him," but then the practicalities set in :
a) The length of time involved would probably preclude us from appointing a new coach - very important.
b) Would be a very expensive exercise to run.
c) Enormous behind-the-scenes pressure would come from the AFL.
d) Constant Media coverage likely to unsettle Club Sponsors and acquisition of new ones.

We've done our best to help make them the biggest bunch of losers in AFL history (not VFL history, sadly), we can only continue to give them a helping hand.markp wrote:Siren-gate, whispers in the sky, Farmer and the Baker stitch-up.... alway freo, like a bad coin!... and always we do nothing.
I'd be interested to see if ESP have cause to pursue any compensation for breach of contract.

Is $3.5 million for the first year (and a million a year thereafter) being reliably quoted?... add that to paying harvey out... gee I hope they choke on this.degruch wrote:It is, without doubt, one of the dodgiest moves of all time. The more I think about it, the more unprofessional and unethical it seems.

Cripes...no idea if it's true, but EPS would be really pissed about missing a cut of that!markp wrote:Is $3.5 million for the first year (and a million a year thereafter) being reliably quoted?... add that to paying harvey out... gee I hope they choke on this.degruch wrote:It is, without doubt, one of the dodgiest moves of all time.
